Win vs. Loss: What are Damages in a Personal Injury Lawsuit?

When you have been injured in a motor vehicle accident , slip and fall, been bitten by a dog or have some other personal injury claim, and your injury is a result of someone else’s negligence, you have five (5) categories of damages. You may be eligible for compensation for each of these categories.

The categories are:

    1. Medical bills

If you have been injured due to the negligence of another person, you have the right to have that person or his insurance companies pay for your medical bills related to the injury.

  1. Future Medical TreatmentIf your treating doctors believe you will need future medical treatment related to the injury, you have a right to be compensated for the cost of that future medical treatment.
  2. Lost WagesIf you have missed work due to the injury, you should be compensated for your lost wages.
  3. Impairment of Your Power to Earn If the negligence of another person has caused you an inability or decrease in your ability to work and earn money in the future, you are entitled to be compensated.
  4. Past, Present & Future Pain and SufferingIf you have suffered an injury and received medical treatment for that injury due to the negligence of another, you are entitled to a monetary award for your past, present and future pain and suffering.

While no amount of money can take an injury or pain away, a Kentucky personal injury lawsuit can certainly be successful if the injured person is fully compensated for the damages they have incurred.
