The Most Common Types of Personal Injury Cases Our Attorneys See

1. Car Accidents

This one shouldn’t be a surprise.  Unfortunately, car accidents occur every day.  Most accidents occur due to a driver’s inattention, such as running a stop light or rear ending another vehicle at a stop sign. However, some accidents are caused by one driver being under the influence of drugs or alcohol.  In these situations, the value of an injured person’s claim could be higher due to actions of the at fault driver.  There is a two (2) year statute of limitations on these claims in Kentucky.

2. Slip & Fall Cases (Premises Liability)

Sometimes a customer will fall at a business. If the fall is a result of negligence on the part of the business, the injured person could recover damages against the property owner for medical bills, pain and suffering, or lost wages. However, you have to be able to prove that the property owner knew or should have known about the dangerous condition that caused the fall. I’ll give you an example. If you are at a grocery store and slip on a substance that had just been spilled only moments before by another customer, it would be difficult to prove fault on the grocery store if they didn’t have adequate time to discover and clean the spill. By contrast, if that substance had been there for several hours and grocery store employees neglected to clean it up, that certainly would be negligence. There is a one (1) year statute of limitations on these claims in Kentucky.

3. Dog Attacks

We see a lot of these.  If a dog causes injury to another person, the dog’s owner is liable for the injuries.  The dog doesn’t actually have to bite the person either.  The dog could jump at a person or simply frighten the person and cause injury.  The only defenses to a dog attack are if the dog was provoked by the person who was attacked or if the person was trespassing on the dog’s property.  There is a one (1) year statute of limitations on these claims in Kentucky.

4. Medical Malpractice

If a person is seriously and permanently injured due to the negligence of a physician, the person could have a claim against the doctor or hospital for medical malpractice.  However, it is not enough to show that you did not have a good result from a surgery.  You have to prove that your injuries were solely caused by the gross negligence of the doctor.  There is a one (1) year statute of limitations on these claims in Kentucky.
