Am I Eligible For Social Security Disability?
To be eligible for Social Security Disability, you must have a physical or mental condition that limits your ability to perform substantial gainful activity (work). The condition must be expected to last or have already lasted 12 months, or result in your death. You must have a certain amount of work credits determined by your age and work history in the last 10 years. Generally, to meet earnings requirements, you must have worked 5 years out of the last 10 before becoming disabled. Earnings requirements for people under 31 are proportionately lower — someone 23 may be eligible even with only a few years worked. Depending on financial need, you might also be eligible for Supplemental Security Income (SSI).
How The Process Works
A very small percentage of claims are resolved at the initial or reconsideration level. Most claims are heard by an administrative law judge. When Should I Apply For Social Security Disability?
Social Security Disability Insurance can be retroactive one year from the date you apply. SSI benefits begin the first full calendar month after you apply. You should apply as soon as you know your condition will last at least a year and prevent you from working.
What If You're Denied For Social Security Disability Due To Work Credits
You may still qualify for Supplemental Security Income (SSI), a supplemental program for individuals who have not worked enough in the last 10 years to qualify for SSDI. SSI is also available for children (under 18) and is based on monthly income and assets for you and your spouse.
